Welcome to Dharma Path. These Terms of Service ("Terms") govern your access to and use of the Dharma Path website, services, and assessments (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, completing an assessment, or otherwise using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Dharma Path provides a self-reflection and personal development assessment tool based on concepts from ancient Indian philosophy, including the Bhagavad Gita. Our Service includes:

  • Online assessments to identify psychological archetypes and natural tendencies
  • Personalized reports based on assessment responses
  • Educational content about Dharma, Varna archetypes, and Gunas
  • Optional consultation services (for paid tiers)

3. Important Disclaimers

3.1 Not Professional Advice

The Service is intended for self-reflection and personal development purposes only. It is NOT a substitute for:

  • Professional career counseling or vocational guidance
  • Mental health treatment, therapy, or psychiatric care
  • Medical, legal, or financial advice
  • Religious or spiritual authority

Always consult qualified professionals for specific advice related to career decisions, mental health concerns, or other professional matters.

3.2 Educational and Cultural Content

Our use of concepts like Varna refers to psychological archetypes based on natural inclination, not the discriminatory caste system. We explicitly reject caste-based discrimination and any use of these concepts to justify social hierarchy or discrimination.

3.3 No Guarantees

We do not guarantee any specific outcomes from using our Service. Results from assessments are based on self-reported data and are meant for contemplation, not prescription.

4. User Accounts and Responsibilities

4.1 Account Creation

To access certain features, you may need to provide information including your name and email address. You agree to provide accurate, current, and complete information.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized access.

4.3 Age Requirement

You must be at least 18 years old to use our Service, or have the consent of a parent or legal guardian.

5. Purchases and Payments

5.1 Pricing

Paid services are offered at prices displayed on our Pricing page. All prices are in US Dollars unless otherwise specified.

5.2 Payment Processing

Payments are processed through secure third-party payment processors. We do not store your full credit card information on our servers.

5.3 Refund Policy

We offer a 14-day refund guarantee for all paid reports. If you are unsatisfied with your purchase for any reason, contact us within 14 days of purchase for a full refund. Consultation services may have different refund terms, which will be communicated at the time of booking.

6. Intellectual Property

6.1 Our Content

All content on the Service, including text, graphics, logos, images, audio, video, and software, is the property of Dharma Path or its content suppliers and is protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit our content without written permission.

6.3 Your Content

Any content you submit through the Service (such as assessment responses) remains your property. By submitting content, you grant us a license to use, process, and analyze it to provide the Service.

7. Prohibited Conduct

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Impersonate any person or entity or misrepresent your affiliation
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any part of the Service
  • Use automated means to access or scrape the Service
  • Redistribute, sell, or commercially exploit our content or services
  • Use our content to promote discrimination based on caste, race, religion, or other protected characteristics

8. Third-Party Links and Services

The Service may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of third-party sites. Your use of third-party services is at your own risk.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DHARMA PATH AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR $100, WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless Dharma Path and its affiliates from any claims, losses, damages, liabilities, and expenses (including attorney fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Modifications to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive.

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Dharma Path regarding the Service and supersede all prior agreements and understandings.
